Terms of Service

These Terms of Service ("Terms") govern your access to and use of NotaryoPH and the remote online notarization services we facilitate. We are a Philippines-based technology platform that connects clients with duly commissioned Philippine notaries who perform notarial acts in accordance with the 2004 Rules on Notarial Practice (RNP) and the Supreme Court’s 2021 Rules on Remote Notarization of Paper Documents (A.M. No. 20-07-04-SC). We are not a law firm and do not provide legal advice.

1. Acceptance and Updates

By creating an account, scheduling, paying for, or joining a remote notarization session, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. We may update these Terms at any time to reflect legal, technical, or operational changes. The "Last updated" date below shows when revisions took effect; continued use after updates constitutes acceptance.

2. Service Description and Regulatory Compliance

NotaryoPH provides scheduling, identity verification, secure audio-video conferencing, and document handling tools used by commissioned Philippine notaries. Each notarial act is performed solely by the notary, independent of NotaryoPH. You acknowledge that notarizations are governed by Philippine law, including the RNP, A.M. No. 20-07-04-SC on remote notarization, the Civil Code, the Rules of Court on electronic evidence, and any relevant circulars or issuances of the Supreme Court and Integrated Bar of the Philippines.

3. Eligibility and Accounts

You must be at least 18 years old, have legal capacity, and have authority over the document you are submitting. Notaries using the platform must hold a valid notarial commission and comply with geographic and practice limitations in their commission and in A.M. No. 20-07-04-SC.

You agree to (a) provide complete and accurate registration details, (b) keep credentials secure, (c) promptly update changes (e.g., address, ID expiry), and (d) notify us immediately of any suspected unauthorized access. You are responsible for all activity under your account.

4. Identity Verification and Remote Session Requirements

  • You consent to identity verification steps required by law, which may include capture of government-issued IDs, liveness checks, audio-video recording of the session, and collection of your signature and supporting documents.
  • You must attend the live video session in a stable, well-lit environment with the same ID and documents you submitted. Providing false or altered documents is strictly prohibited and may be reported to authorities.
  • The notary may refuse, suspend, or terminate the session if identity, voluntariness, or document integrity cannot be confirmed, or if the act would violate law or professional obligations.

5. User Responsibilities

  • Ensure documents are complete, accurate, and ready for notarization; provide any underlying agreements referenced in the document when requested by the notary.
  • Use the platform only for lawful purposes and documents that may be notarized remotely under Philippine rules (certain documents such as wills, powers of attorney requiring personal appearance, or real-property instruments may be restricted or require additional steps).
  • Maintain your own copies of notarized documents and recordings provided to you. We are not responsible for your local storage or backups.

6. Fees and Payments

Fees are shown before booking. Payments cover the platform services and the notary’s professional fees where applicable. Unless required by law, confirmed sessions and completed notarizations are non-refundable. You authorize us or our payment partners to process payments and applicable taxes.

7. Intellectual Property

The platform, including its software, branding, and content, is owned by NotaryoPH or its licensors. You may use it solely to access services for which you have registered. Reverse engineering, scraping, or unauthorized use of our marks is prohibited.

8. Prohibited Conduct

  • Submitting forged, altered, or outdated identification or documents;
  • Impersonation or acting without authority on behalf of a principal;
  • Interfering with security features, attempting to access another user’s account, or using the platform to transmit malware;
  • Using recordings or output for unlawful purposes or misrepresenting notarized status.

9. Disclaimers and Limitation of Liability

The platform is provided on an "as is" basis. To the fullest extent permitted by Philippine law, NotaryoPH disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. NotaryoPH is not responsible for any legal advice provided by notaries, the validity of documents you upload, or outcomes of the notarized document when used with third parties. To the extent allowed by law, our aggregate liability for claims arising out of these Terms or the Services will not exceed the fees you paid for the relevant transaction.

10. Indemnity

You agree to indemnify and hold harmless NotaryoPH, its officers, employees, and agents from any claim, demand, or damage (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of law or third-party rights.

11. Termination and Suspension

We may suspend or terminate access if you breach these Terms, provide false information, compromise platform security, or if required by law or by a competent authority. You may stop using the Service at any time; certain obligations (e.g., payment, indemnity, limits of liability) survive termination.

12. Governing Law and Dispute Resolution

These Terms are governed by Philippine law. Any dispute that cannot be resolved amicably will be submitted to the proper courts of the Philippines, to the exclusion of all other venues, without prejudice to mandatory venue rules.
